Trip Terms & Conditions
This agreement is between you the [“User” or “you”] and 3 SEAS (Collectively, “3 SEAS”, “we”, “our” and “us”.)
The use of www.3seastravel.com, (collectively, “the website or site”) is subject to the following terms and conditions. 3 SEAS reserves the right to update the Terms and Conditions at any time without notice to the user. The most current version of the Terms and Conditions can be reviewed by clicking on the ‘Terms of service’ hypertext link located at the bottom of our webpages.
WHEN YOU USE THE SERVICES IN ANY WAY, AND BY PURCHASING ATTENDANCE FOR A GROUP TRIP OR PRIVATE TRIP PLANNING SERVICE, YOU: (A) ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS OF SERVICE AND ALL OBLIGATIONS AND RULES THAT MAY BE INCLUDED WITHIN THESE TERMS AND CONDITIONS IN THEIR ENTIRETY; (B) AGREE TO BE BOUND BY THE TERMS; AND (C) ARE AUTHORIZED AND ABLE TO ACCEPT THESE TERMS.
If you do not agree with all of the provisions of this agreement, you cannot use the Services. To remove any doubt, in the event of any conflict or discrepancy between these Terms and conditions and any other provisions and/or terms and/or otherwise between 3 SEAS and you, the provisions and the terms of these Terms of Use will prevail. Please feel free to contact us with any questions regarding the content of this agreement.
1. USAGE
You will use this site in a manner consistent with any, and all, applicable laws, legislation, rules and regulations. If you violate any restrictions in these terms, you agree to indemnify 3 SEAS for any losses, costs or damages, including reasonable legal fees, incurred by 3 SEAS in relation to, or arising out of, such a breach.
2. PLAN YOUR TRIPS
You can plan your trips and travel later with ease. What is required is for you to indicate your interest on any of the group travel trips displayed on the website and make your deposit. You also have the option to customize your own special group travel with your own friends and we will facilitate the planning of your travel.
Please note that flights are not included (unless stated otherwise) in the services we render. We will be here to assist you to find the best flight deal possible for your budget and place of departure.

3. APPLICABILITY
“These general terms and conditions (the “Conditions”) apply to:
(a) The use of any information, pictures, documents and/or other services offered by 3 SEAS via (our “Website”);
(b) The subscription to any of the services, customization and planning of group travels provided on the website.
4. CHANGES TO TERMS OF USE AND SERVICES.
THESE TERMS MAY BE AMENDED OR CHANGED BY US IN OUR DISCRETION, WITH OR WITHOUT NOTICE, AT ANY TIME. We indicate at the top of the page when these Terms were last updated. Your continued access or use of the Website or any other Services following such changes will be deemed acceptance of such changes. In addition, we reserve the right to modify or cease providing all or any portion of the Services at any time, with or without notice. Be sure to return to this page periodically to ensure familiarity with the most current version of these Terms. 3 SEAS retains the right to refuse service to any Client at any time, for any lawful reason whatsoever, in its sole discretion.
5. ACCESSING OUR WEBSITE
While we endeavor to ensure the Website is available 24 hours a day, we do not guarantee that our website, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or part of our website without notice. We will not be liable to you if for any reason our website is unavailable at any time or for any period. You are also responsible for ensuring that all persons who access our website through your internet connection are aware of these terms of use and other applicable terms and conditions and that they comply with them.
6. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
The Trip Planner reserves the right to make changes to any and all aspects of travel meet up (which may include without limitation changes to the types and/or timing of activities available during the travel meet up, the hosts, items and/or services included with the travel meet ups, accommodation, the itinerary, and/or the nature of the travel meet up activities if, in The Trip Planner ’s sole discretion, The Trip Planner ’s deems it necessary to do so due to conditions that may be hazardous, dangerous, or otherwise adverse or threatening, if an act or omission of a third party prevents any such aspects of the travel meet up or any portion of the travel meet up, or for any other reason considered commercially necessary by The Trip Planner. You will not be eligible for any refunds of any amounts based on any such changes to the travel meet up. All displayed accommodation is to be reserved and only confirmed on the basis that all trip slots sell out. Should this not be the case, the trip planner reserves the right to adjust the provisionally reserved accommodation to an alternative suitable option, to for the final size of the group attendees.
The itinerary is a general guide to the tour and region and any mention of specific destinations is not a guarantee that they will be visited or encountered – therefore the Trip Planner may make improvements that stem from weather changes, local factors, past travelers’ comments, and research, to name a few examples. As a participant, you also expressly acknowledge these terms and assume responsibility for inherent risks associated with physical activities you participate in.
7. PASSPORTS, VISAS AND ENTRY REQUIREMENTS
You are responsible for obtaining and maintaining a valid passport and all appropriate visas, permits, certificates, and/or other required documentation (“Documentation”) for the countries, jurisdictions, parks, areas, etc. you will visit during the travel destination. 3 SEAS is not responsible if you are denied entry or exit to/from any country or location due to a lack of valid Documentation.
8. ALL TRAVEL CONTENT (INCLUDING IMAGES & VIDEOS)
The Client using 3 SEAS services agrees that while participating in any getaway or trip, product images, photos or videos may be taken by 3 SEAS , other Clients and/or 3 SEAS’s representatives or Experience Providers that may contain or feature the Client in part or in whole. The Client acknowledges that they consent to any such pictures being taken and agree that hereby grants a perpetual, royalty-free, worldwide, irrevocable license to 3 SEAS , its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to the Client or compensation payable to such Client.
PHOTOS, VIDEO, OTHER MEDIA RELEASE By and in consideration for being permitted to participate in the trip, you irrevocably grant 3 SEAS and its agents and representatives all rights to use, reproduce, display, exhibit, publish, distribute, and/or produce derivative works based on your image, likeness, and voice as recorded by any camera and/or on any video, audio, and/or other media (collectively, “Likeness”) worldwide, in perpetuity, without compensation, payment, or other additional consideration of any kind, for any lawful purpose, including without limitation for marketing and trade purposes.
By using 3 SEAS services, you agree that your Likeness may be used, reproduced, displayed, exhibited, published, edited, or distributed by 3 SEAS at its sole discretion. You understand that your Likeness may be used in various publications, promotional or marketing materials, and/or social media, unrestricted by time or geographic area and consent to such uses. You further understand and grant permission to 3 SEAS and its agents and representatives to electronically display any Likeness of you on the Internet or in other public settings. You hereby waive the right to inspect or approve any and all materials in which your Likeness may appear. You further waive any right to royalties or other compensation arising or related to the use of your Likeness. This release applies to all photographic, audio, and/or video recordings collected as part of, in connection with, and/or during the trip participated in (by 3 SEAS or any third party). There is no time limit on the validity of this release nor is there any geographic limitation on where materials including your Likeness may be used, reproduced, displayed, exhibited, published, and/or distributed by or on behalf of Company.
9. PAYMENTS
Managing your Payments
You can secure the trip by paying a small deposit. The remaining balance can be paid across a period of monthly instalments. 3 Seas is happy to create a payment plan that works around your preferred dates and months (service charge and administration fee applies). Alternatively, you also have the option to make a one-time interest fee payment.
Attendees must adhere to the payment plan dates set. If the 3 Seas does not receive your payments on or before the payment due date, they may cancel your reservation and you will forfeit your deposit and the amount paid thus far.
Late Payment: Failure to make a payment within fifteen days of the agreed upon date is a breach of contract and may result in the cancellation of your experience. If you are having trouble with making a payment you must email info@3seastravel.com to notify the planner to avoid a late fee. The Trip Planner maintains the right to assign your spot to the next eligible individual on the wait list.
Payment Processing
Payments for our services can be done via the website with debit or credit cards. By providing a card payment or other payment method that we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for all charges you incur for the purchase of any Subscriptions or other Products (including any applicable taxes and other charges). You are responsible for, and agree to pay, all such charges. If we or our third party payment processor cannot obtain authorization for charges to your payment method or if any amounts you authorize us to charge to your payment method are reversed or charged back for any reason, we may, at our option, in addition to any other remedies: cancel or suspend any of your subscribed trips, make second and/or subsequent attempts to charge your payment method, and/or use any other lawful means to collect payment on any outstanding amounts due to us. You will remain responsible to pay all applicable charges for all Orders.
Cancellations
a) Any cancellation of a booking by an individual must be delivered to The Trip Planner, The Trip Planner in writing and be acknowledged by The Trip Planner in writing to info@3seastravel.com
b) All trip deposits are non-refundable. You may request to have your payments applied to another participant’s registration; however, it will be your responsibility to find this participant.
In the event of any change or cancellation under this , you acknowledge that you will have no right to a refund of payment (whether in whole or in part, except as expressly provided in and no right to claim compensation for any Liabilities incurred and/or sustained by virtue of any change or cancellation. Our vendor (s) for example, accommodation, transport and excursion companies, etc. require upfront commitments that must be adhered to the non-refundable policy.
Cancellations 24 weeks or earlier until travel date – Fully refundable instalments, non- refundable deposit
Cancellations within 24 weeks of travel – 30% of your paid balance is non-refundable
Cancellation within 4 weeks of travel – 100% of your paid balance is non-refundable
When the travel meet up package is offered to you (the individual) we have to ensure, through good-faith payments, that you will attend the group trip. Your group trip also includes other attendees, who are still scheduled to travel ahead, therefore should not be affected as a result of your own travel changes.
Our non-refundable policy also applies to private trips however travelers can amend dates up to 12 weeks before initial travel dates.
10. DISCLAIMER OF WARRANTIES & LIABILITY
PLEASE NOTE THAT THE SERVICE WE PROVIDE TO USERS ARE PROVIDED ON AN ‘AS IS’ and ‘AVAILABLE BASIS’.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our website or any content on it, whether expressed or implied. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence) breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, our website and information.
We will not be liable for:
- Loss of profits, sales, business or revenue
- Business interruption; or
- Any indirect or consequential loss or damage.
We will not be liable for any loss or damage caused by a web virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website or to you downloading any content on it, or on any website linked to it.
We assume no responsibility for the content of websites linked on our Website. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
11. INDEMNIFICATION.
To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless 3 SEAS, and our respective past, present and future employees, officers, directors, contractors, consultants, equity holders, suppliers, vendors, service providers, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors and assigns (individually and collectively, the “3 SEAS Parties”), from and against all actual or alleged 3 SEAS Party or third party claims, damages, awards, judgments, losses, liabilities, obligations, penalties, interest, fees, expenses (including, without limitation, attorneys’ fees and expenses) and costs (including, without limitation, court costs, costs of settlement and costs of pursuing indemnification and insurance), of every kind and nature whatsoever, whether known or unknown, foreseen or unforeseen, matured or unmatured, or suspected or unsuspected, in law or equity, whether in tort, contract or otherwise (collectively, “Claims”), including, but not limited to, damages to property or personal injury, that are caused by, arise out of or are related to (a) your use or misuse of the Sites, Content or Products, (b) any Feedback you provide, (c) your violation of these Terms, (d) your violation of the rights of another, (e) any third party’s use or misuse of the Sites or Products provided to you and (f) any User Content you create, post, share or store on or through the Sites or our pages or feeds on third party social media platforms. You agree to promptly notify 3 SEAS of any third-party Claims and cooperate with the 3 SEAS Parties in defending such Claims. You further agree that the 3 SEAS Parties shall have control of the defense or settlement of any third-party Claims. This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and 3 SEAS.
12. UNAUTHORIZED USE
You are responsible for configuring your information technology, computer programmers and platform in order to access our website. You should use your own virus protection software.
You are prohibited from posting or transmitting to or from the Website any material:
- that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence or in breach of privacy; or
- for which you have not obtained all necessary licenses and/or approvals; or
- which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or
- Which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).
You may not misuse the Website (including, without limitation, by hacking).
You acknowledge that we will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting any material in breach of this section.
14. SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
15. TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
16. ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
17. GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England. In relation to settlement of any dispute between you and us, the federal and State courts sitting in England shall have exclusive jurisdiction.
